    nj wage garnishment

    filed chap 7 PRO SE Jan 9. creditors meeting Feb 13. My wages are still being garnished. Should the garnishment have stopped Jan 9, or not until discharge? Do I need to notify my employer, the court, or the attorney garnishing my wages? Will I / can i get money taken since Jan 9 back? TIA-

    Did you include the entity that autorizes the garnishment in your creditor matrix.


    For a civil garnishment in my county it was the Sheriffs Civil Bureau.
    Look at the garnishment order and see who actually placed the garnishment, not just who had the judgement but the entity through the courts that issued the garnishment to your employer.

    Your garnishment should have stopped shortly after you filed BK.

    DId you included the judgement/creditor in your schedules?

      There were two garnishments. One stopped and one did not. I received a check from the Sheriff's Office for what, I assume, was garnishment money taken after Jan 9.

        Go back and make sure both are listed in the paperwork. I would notify the bank and your employer that they are taking the funds in violation of the automatic stay. If they persist inform the trustee/judge, after all while in bk the trustee is in charge of the bk estate and they could be taking funds that belong to someone else if your found to be an asset case.
