    unexpected medical bills

    We are in the process of a chapter 7, just waiting for our signature to file when we absolutely have to. What happens if I just found out I need surgery? Not emergency, but necessary.

    Can I file this? Would that be considered fraud? I don't see how I'll be able to pay for the balance after my insurance pays - its amazing I can still afford the insurance.

    Anyone out there with this experience?

    Don't file until you have the surgery and are recovered. You want all debt included in the bk.
    Medical care is not fraud.

      Did you ever list the hospital as a creditor for any other bill in your matrix? If so, wait until your surgery. However, if you have the surgery and did not list them after you filed (signed)you will be required to pay.I would think if you list them and then have the surgery that may consider fraud. However, not if they were already listed.

        Have your surgery then file. As long as you list all of the creditors after your surgery you will be fine. We got a bill a month or so after we filed and we added it but had to pay $25. Hey, worth it to get rid of the $800! Our lawyer kept canceling for our filing and it worked out as I had a minor surgery that turned into a major and it was all included in the bk. And we filed a week after!
