my last day for creditor objections was today.... the bank still hasnt done anything about recouping a 2007 honda fit financed through them with over 13k owed....

I am dreading giving it up , but i dont want them to be able to say i didnt surrender it....

    any ideas?

I am assuming you checked off the 'surrender' option on your statement of intentions in your petition.

If so, let them contact you after the BK to make arrangements to pick up the car.
Don't call them. I called and they picked it up right away!

Good thing to keep in mind. Drive that thing for as long as possible... it'a free rental until they come pick it up! I am about 90 days past due on my BMW. I have blocked the bank's phone # from my line since they were hounding me with automated calls every day. For some reason they are not writing me and the repo man hasn't been knocking on the door. So in the mean time I am using it to dump out the trash when needed.

Also, what happens if the repo man comes looking for the car and you just never happen to be around when he comes? Do you get into trouble for that? Let's say I am past due 100 days and the repo man has made 6 attempts to get the car, but I just happened to be out of town for a month or two for business or something else? What's the worst case scenario?

We're out of money right now and we were looking to go spend some time with family who live 6 hours away. We also won't be home to get phone calls neither. So if the repo man came, he would never find the car anywhere. They may even be looking at my old job that I had when I first bought the car. Who knows?

I can still legally drive the car, right? I have full coverage insurance on it.
