I read the whole thread, and both sides make good points. I believe that once we find that someone might be sensitive we may want to ease up a bit. That said, I'm sure we want people to be honest in their posts. I, personaly, would like to hear the good and the bad. I believe that someone mentioned that this forum is equivalent to how the Trustee would view things. I haven't had my 341 yest, but if i can get some insight into how the Trustee might see things, so be it. Some Trustees are nice and kind while I'm sure others are rude and crude.

Let's just all take a deep breath and understand that we are all in this together.

        WING,
Back to your original posting (all bashing aside).
Is it too late to file? NO.....
Will you qualify under Chapter 7 in the new laws? Probably.....
I would get my ducks in a row quickly, and file under the old rules if I could. You still have time.
A simple no-asset case (no home, no sellable assets) you could file yourself using the Form 7 software. But remember if you file yourself you are responsible for submitting anything your lawyer would and in a timely manner.
Sometimes hiring a lawyer is a good thing if you do not feel comfortable that you will do it correctly.
You do not want to do anything that would get your case thrown out or dismissed.
Use your own judgement in hiring the lawyer - try a paralegal in a lawyers office to help you with the paperwork. They are cheaper......

        Good luck,
Let us know what you do decided.

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

          Yup,

Like one big happy (fighting and arguing) family...

I apologize to anyone who took my comments to heart...Please dont think I am condoning anyone to be rude to get information across to someone...By all means the nicer the better...But you do have to remember that some people read words one way and some the other...If you are reading with emphasis on certain words...Yea..some posts might sound very rude...But someone else might not take it as that...I can see how Lightning came off rude after reading it a few times...(I dont think he meant to though) Anyways, not meaning to ramble Totally off Wing's thread...So good luck Wing in your journey with B/K...If you need help your in the perfect place...
