    Day 94 Awaiting Discharge

    Day 94 and counting. Pacer still shows "awaiting discharge." Last filing was our credit class completion paperwork back on Jan 9. Final day for objections was Feb 27.

    Emailed and spoke with our attorney, and was told there's nothing they can do and the courts are busy, hang on, etc. I asked if they could call the court clerk on our behalf and see if there was someone who could press the right button or whatever.

    Was told they had already tried that, blah, blah. I almost don't believe the attorney called, but I suppose they could have. I'm paid in full, and feel like we're just a pain to them now.

    Anyway, since there are no objections, I suppose we are in the clear, atleast on the creditors objecting part. But, man, when are they going to discharge us? And should I keep bugging my attorney, or just relax like they told me to?

    I know I shouldn't have expected a discharge on day 61, but we're on day 94 now. We are in Southern California, chapter 7, no asset.

    Seems like all of Ca. at least So. Ca. is like that.. Relief had to wait like forever also..After 60 days its just paperwork right? Can the trustee even do anything anymore?

      JK - I am also in So. Cal and wasn't discharged until Day 115.

      Did you file in Riverside by any chance? I called the court so many times and got answer why I hadn't been discharged. All they would tell me is that "you are on the list".

      On Day 115, my husband and I were SICK of waiting so we drove down to the courthouse in Riverside. I was very nice, but persistent, and the lady discharged me right then and there.

      341 - 11/26 went smooth NO ASSET
      Took 115 days after 341 - But Finally DISCHARGED 3/25/09

        Santa Barbara for us. We just want this to be over like everyone. Day 115 and you had to go in to get it discharged, yikes. So, so far, we are not alone.

          I think it unlikely (knock on wood) that anything is going to happen. I'm sure the trustee could do "something", but since we were honest and didn't hide anything, I'm not too worried about that.

          Just want it to be over, and I thought I was being patient. After 85 days, it was starting to bother me about no discharge. My attorney just says to wait and there's nothing holding us back from the discharge.

          The only thing about the attorney is that when I initially emailed, I was told they would check with things and get back to me within a week. No response after the week. Then I called, and didn't get a call back in 2 days. I called a second time voicing my frustration, and got a call back straight away, and responses again from my emails.

          In other words, we don't seem very high on our fully paid lawyers list, but high enough to not completely ignore. Although, they did say they called the court about it. Lawyers don't lie, right.

            I filed In SB too, call them yourself and ask " are discharges taking longer than usual?" with a very sweet tone. The clerk discharged me while I was on the phone.

                  JK, we waited six months until we called the bk clerk who put us to our case worker. Our case worker said they needed our marraige certificate (we use two different sir names). I asked is that all? She said yes. I emailed my lawyer with a pdf of the document and in two hours PACER showed disharge. I was never told about the certificate so they make mistakes too. 'Hub
