    Filing Pro Se Ch7 In Texas & Have Questions

    I've been considering filing BK for some time and due to a recent screw up on my part with payday loans I've dug myself in a hole so big I can't fathom getting out of. I've got around 10k cc & medical debt, and am now in for another 2k from payday loans (and the ridiculous fees).

    Anyway, I own a car free & clear, and am renting. I have no other assets to speak of.

    So here's the question, the payday loans that I've done are all within the last few months and I'm scared that they are going to fall under this:

    Debts for obtaining money, property, services, or credit by means of false pretenses, fraud, or a false financial statement if the creditor files a complaint in the case

    Am I correct? I def. don't want to get this dismissed so I'm asking here first. It says "false pretenses" which they really weren't, but I'm not sure how this is looked upon.

    Probably not, I would certainly list the pay day loans on your petition. Payday loans tend to be relatively small, so its not usually worth anyones time and effort to pursue them.
