Down to the wire and TT still not cooperating

OK, so I have my THIRD 341 scheduled for 4/15/09.

The TT keeps on objecting to items even though I have all the documentation to back it up.

My attorney told me to see if I could find more in the way of medical expenses, business expenses etc with reciepts in order to have more of a cushion.

I have found a ton more than I thought I had and I have all the proof of expenses over the IRS guidelines.

My attorney told the TT, why not just let me file electronically to amend and then send you the proof and continue for two weeks more to give you time to examine.

The TT said " we will decide on the 14th, the day before the 341 wether or not to bring all the proof with you, or let you mail it in.

I don't understand what the logic is for waiting until one day before the 341 and making me run around to copy all the items when they are probably going to continue anyway even if I go to the 341 and hand it to them.

I can't imagine that they would maker a decision then and there on the spot.

My attorney said to comply and maybe we won't have to go to another 341 afetr this one.

Man, my attorney must be SICK of me and this case by now.

Well it does seem bad form on the TT, but just keep meeting what they say and you'll come through eventually .

I'd carry it all to the 341 meeting. That way you can get it on record you handed it to him right then and there as he has the recorder going.

Now my 341 hearing is again reset for May 11th.

Jeez, I filed in December of 08.

Oh well I guess it could somehow be worse. I don't know how, but it could be.

Your going to be waiting 5 months til your 341? Geez thats a long time. Is it because they are so backed up in Ca.? That means it'll be 7 months or longer before your discharged? Crap what a nightmare, sorry..

Sorry to hear that your Trustee is being a hard *ss. He sure is dragging this out, I'd be a bundle of nerves right now...hang in there...
I'm in CA too, I hope I don't get this Trustee!

I don't think that they are backed up they are just challenging everything I have looking for inconsistencies.

Maybe it has to do with me having a law degree which the TT knows about. It does not make me any smarter but my attorney thinbks that they might figure that I know some ways around the system.

I also make more than the median, although much less than the past few years, have $220,000 in unsecured debt, was a TT for a big bank account with my name on it but no access to the funds ( THAT was fun copying two years of statements along with my personal bank accounts) , have a high house payment, lawsuits against some criminals that defrauded me on a land deal, am 1099 with business expenses and who knows what else thay are picking on.

Waiting for the discharge is OK with me, I just want to get back to something productive and make some money. This is SUCH a waste of time and energy. I simply do not have the money that they think I do.

Jeez, I was up until 3 AM recalculating figures and preparing my means test, the I and J schedules.

I have EVERYTHING to back my figures up so they are wasting their time as well as mine.

At last count I had sent them over 600 pages of items. Now I have to copy and send every receipt for everything relating to my Means test so tomorrow will be another wasted morning.

Well, at least i will be able to help others on this forum in the future.
