I've been up for 3 days trying to figure out when we should move. We filed BK on 4/15. Our meeting of creditors is 5/19.
We are losing the home we live in. It's a mobile home being bought from the park. According to our papers we are automatically in default the minute we file BK. Everything converts to rent and they file for eviction. However, we were only 2 weeks late on our payment, they never had a chance to file.
I know they can request a relief from stay. I have no idea how long we have to move. Evictions here take about 21 days, but I don't know how long until they request the stay.
We do have an offer to rent a home for 950.00 but its temporary, the house will be going into foreclosure. That takes a min. of 3 months I think. But does it give us more time? After its sold when do we have to leave, would they offer us cash for keys or evict us? We are in Ohio.
Attorney said if we are going to up our monthly home payment it would help to do it now. If we would have 3-6 months to save by moving into the foreclosure, as opposed to 30 days in our home then is it worth doing? We do not have money for a deposit and they aren't requiring one.
Which is more risky, waiting out the MHP or renting the foreclosure?
