How late can you technically file before the new law is in effect? Is it as long as your attorney submits it before Oct. 17, or does your 341 and everything have to be done by then? Can we submit it on our own without an attorney if he is dragging his feet?

The petition has to be filed by Friday Oct. 14 if you're doing it in person, or by midnight on Sun. the 16th. (Attorneys can file electronically.)Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

If your going through an attorney and your district is using e-filing, then technically, your attorney could file the case as late as 11:59, october 16, 2005. Although, I don't think that will be possible because I think the ECF system (that is what they call the e-file system), will probalby be shut down over the weekend to upgrade the software for the requirements of the new law.
So I have a feeling, that close of business on Friday, October 14, will be the latest anyone can file under the existing law.
