    341 Monday - Questions!

    I have read a lot of posts about "lists from the trustee" and "what to bring". My attorney told us to bring ss cards - and we haven't heard from him since we filed a month ago (He's great - but busier than EVER).

    We did get a form in the mail a while ago with the time and place of 341... but were we supposed to get anything else?

    Also, I read so much about emptying your checking acct. My atty. said "You can have $5k in your acct. It wouldn't matter."

    We won't have $5k... but we might have $1500... I guess I shouldn't worry if he said not to worry - We are no asset and don't have much equity in anything so I guess that's why we're ok....

    What to bring:

    1. Valid State Issued Photo ID Card (This can be a military id, passport, driver's license, state ID card so long as it is issued by a State or Federal Government of the United States).
    2. Your Social Security Card.

    If your lawyer told you you can have 5k I wouldn't worry about it, might be some wildcard exemptions he's not used yet that he's saved for it just in case.

    IF you've received no other requests from the Trustee or Lawyer then you really don't need to bring anything else.

    Some general rules for attending 341s

    1. Don't be late
    2. Do not bring cell phones, cameras, or other electronic devices. (They will be confiscated by the guards if you bring them but you'll get them back when you exit).
    3. Dress nicely but do not rush out to splurge on an expensive dress/suit, wear what you might wear out to eat for a casual meal.
    4. Leave the jewelry at home, a plain wedding band is fine but don't wear anything else other than maybe a plain watch (like a watch you'd buy at Wal Mart. (Jewelry of value can be seized on site by the Trustee if its not listed on the paperwork due to even an innocent omission.).
    5. Do not bring children.
    6. Possibly bring a book to read if you plan to be very early or a newspaper remember no electronics......

      I ditto what JR said. Make sure you have your ID and your SS cards. Other than that, try not to sweat it. If you are a simple no asset 7 case, chances are you will breeze through this with no problem.

      If your lawyer wasn't worried about your bank account, you shouldn't be either. If that were a problem, you would have been asked to bring your bank statements.
