Hi everyone, I have filed BK on sept 16th, my 341 meeting is on the 19th of Oct. I have filed Pro-Se. So far everything has gone great but one Question. I have a mobile home in a mobile home park. I am moving out on the 15th of Oct. I am surrendering the home. My lienholder has advised that they do not plan on asking the court to lift the stay and they will take possession on the last day that creditors have their chance to dispute which is Dec 19th. The problem is the parks lawyer is saying I am responsible for Post rent due. Even though I am moving out I am still responsible since the lienholder is not taking possession until dec 19th. I have also read that the lienholder has apporx. 30 days after filing to take possession. My understanding is that when you file, your property is in the hands of the trustee, this being said can they charge me post due lot rent? Is there anyway to avoid this extra cost. Or force the lienholder to take possession quicker. I just don't have enough money to pay for our new place and this rent. Any advice. Please!!!

You should have included the rent in your BK. If you did not, then you can amend your petition.Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

You should have included the rent in your BK. If you did not, then you can amend your petition.
How can I include future rents? when you file BK your asking for a discharge from what you owe now, I did include the park / lease in the BK. But the parks' lawyer is saying I will not have to pay any rents owed prior to filing but if the lienholder does not take possession now then I am responsible until they do.
Any help???

I'm not really sure about future rents... I didn't consider that aspect! I know utilities can charge you for the time from file date & later for services used, I don't know about rent.
