Received "motion for order granting relief from automatic stay

and Notice in the mail yesterday for my mortgage. In this they say we are $3,041 behind which includes attorney fees, interest, etc. I have until June 15 to to file a written objection. If I pay this payment, will they most likely stop foreclosure proceedings? It looks like Indymac bank transferred my mortgage to Onewest Bank on May 22 of this year. Is that a bit odd? We were discharged in June '08.

None of us can speak for Onewest Bank. Contact them and see what they say. Did you reaffirm the mortgage?

we didn't reaffirm, were planning on doing a ride through until we missed the missed the payments.

I'd call em up and see what you can work out if you want to stay in the home. If you don't or you can't afford the home now it might be time to look into renting a new place and walking away.

Sorry this trouble has come up but at least you didn't sign a reaffirmation agreement.

Thanks...I did call them..found out it the Motion for relief of stay will go through, but then it will take about 30 days for the foreclosure process to begin. So if I am current by then I will be fine.
