    Checking Account

    If you have 2 checking accounts..but one had a 3.00 balance at the time of filing..and it doesn't have any creditors attached to it...do you need to still list it? We only use the checking account we did list.

    You are supposed to list "all" accounts you have, no matter the balance......same way with all creditors.....

    If the truste finds you didn't list an account, he may go looking real close at everything else also....

    Don't send up an unncessary "red flags" for him....

      Minny...thanks for your response. Are we suppose to list creditors like our phone bill & Cable Bill? We are not behind on those at all. Also, how does a trustee find out if you forgot to list a creditor like that or a bank account that you don't own any money to?

        For cable, etc. if you aren't behind then they're really not credit accounts because you pay for service ahead. (Your Oct bill is likely for November billing.) If you are past due, you could include the account to discharge the prior balance. (Keep in mind that they can charge you for services used after the filing date, and can charge a deposit.)

        Truth is-the trustee probably will not find out about your other account. But if he does, he will probably dig through everything else to see what else you 'forgot'. Its best to list everything.
        Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's.             It seems like you are awfully concerned for an account with only 3 bucks in it. Are you sure you are being straight about the amount in the account? I'm not saying you are hiding anything, it just seems a bit fishy that you are overly concerned about the trustee finding out about the account. I don't think she will, but to answer your question, I believe there is a way for the trustee to search your assets using your SS#. Your SS# is used to open bank accounts, so any that are still open would show up. If you are worried, just amend your petition to show the account. If there is only 3 dollars in the account, there sould be no reason for not amending your petition.

              Yes..that is what I am doing in the morning..found out you can amend your chapter 7...and there was only $3.41 in the account...so this won't effect anything..i don't think.

              I am awfully worried, because it says any false statements could be considered fraud...well it was false to state only 1 account when I had 2, but was not on purpose..an oversight of an account not used for business. My husband says I am a "WORRY WART" and to just amend....

                this is going to sound really stupid, but where do you list checking accounts? I used form7 and didn't see anything where it asked to list banking accounts. ???

                  The key to something NOT being a false statement (ie not fraud) is...to the best of my knowledge. When you filed your petition, you had forgotten about the other account. So 'to the best of your knowledge'.... you signed your petition in good faith. Not to worry; just amend.
