    Listing Credit Accounts

    I was told by an attorney that if we did not want to include something like our car or a certain credit card that we need to make sure they are current and then just do't list them.

    Any advice or reaction to this? Will I be setting myself up for problems or is this legitimate?

    I don't know about that, you're supposed to list ALL debts in your filing

      Your supposed to list all debts and creditors......
      Deliberately not listing some could result in a dismissal of your case if discovered.
      Your attorney sounds a little "shady"...... Beware!!!

        Thanks for the insight. So far I have only filed the initial petition and the matrix. How should I go about adding the address of my missed creditors?

          we didnt want to list our car, cause we are keeping it and we are current.

          However since we owe money on it and it IS a debt we have, BY LAW you have to list it. I don't understnd why your lawer told you otherwise. Do what the law says....that is who to have to answer to and who's rules you have to follow not your lawyers.

            Some possible downsides to your attorney's advise. If you don't list your car, you can't claim a car payment, insurance, and vehicle maintenance on your expenses schedule. If you can't list those, your budget will show ample income remaining to go into a 13.

            Some argue that a $0 balance credit card account doesn't have to be listed-but don't use it during the process. It will likely be closed anyhow once the creditor reviews your account, and having charges after filing can get you in trouble.

            To update your paperwork, you'll need to file all your schedules. You can do a matrix, and note it as 'amended'. You mentioned you have an attorney-is he not helping with this, or was it just someone you consulted w/ but didn't hire?
            Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

              Actually, I do not have an attorney. We visited one before we filed. The fees were very expensive. If we could afford them we probably would not need to file bankruptcy.

              Anyway, could I just ament the matrix and take it to the Bankruptcy Clerk's office?

                I am in NC and if you owe then money, then you better list it. Yes you can ammend it, at least up and until the 341. Our attorney ammended ours that morning and brought a copy in. Too bad you didn't check her out she is great and better than reasonable. Good luck keep us posted.
