    Had My 341 Meeting Today

    I had my 341 meeting today in Detroit. It took me longer to find a parking space then the meeting itself took. My attorney asked me most of the question which were the standard ones. The Trustee then took over and asked me only one question which was if I am keeping my car lease and I confirmed. None of my creditors made an appearance. I had all the documents that I could think of but was only asked for my 2004 tax return docs and car lease agreement... that's it. Done in about 2 mintues, if that long.

    I got there about 2 hours early to watch some cases before me. Nothing major for anyone. A couple people's attorney didn't show up and had to be rescheduled. One lady had to have an interpretor with her because she couldn't speak English. There were a few chuckles from room when she kept saying yes or no before the interpretor could relay the question back to her. I did see one creditor show up... it was for a car loan and the person also had a CC bill from the same company that financed the car. No big deal really... I seen her chatting with the person before their turn, she was telling the person what she was going to be asking her. She seemed very friendly.

    I seen one person get kind of grilled but it was really his own fault. He was a loud mouth and the Trustee had to stop a meeting 3 times to tell him to shut up. So by the time it was his turn the Trustee already seemed irritated with him. Plus it didn't help that his wife was with him and was smacking the gum she was chewing and they also just had a Chapter 13 discharged only a year ago. The Trustee told his lawyer he should be going Chapter 13 again. The lawyer said OK and would counsel him on it.

    There were a few people that had some issues as well. Like one lady claimed to have only $46 (that's forty-six dollars) of monthly income but yet was wanting to keep her home that had a $800 mortgage payment... She nor her lawyer could answer when the Trustee asked how that is possible. I guess they figured he wouldn't look or something... Then there was a guy that didn't bring the title to his car but was allowed to fax a copy to the Trustee when he got home. I only seen one person without a lawyer and his went pretty well. No problems and no grilling.

    The only documents that I seen the Trustee ask for was any car titles, real estate stuff, mortgages, IRA docs, car lease agreements, and tax return docs. I didn't see one person get asked for any bank statements or pay stubs.

    It was very crowded today. I can only imagine what it will be like when all the last minute filers start coming in for their meetings. There was a few delays because the Trustee was allowing some of the lawyers to go find their clients. This was because at the last second the court changed rooms around to accomodate for the big crowds so some people went to the wrong room (actually the right room according to their 341 notice). So things were a little unorganized on the courts part and I am sure it will be alot more unorganized very soon.

    Now that mine is over I feel alot of weight being lifted from my shoulders. I found these forums about 2 weeks ago and been up reading alot of late nights... drinking coffee... right out of the coffee pot. The stories and information here has helped me out alot and hope my story helps out the people on deck.

    Oh ya, I forgot to mention that the loud mouth guy also had diamond earrings in both ears dangling down to his shoulders. I am no jewelry expert but I know they did not come out of some bubble gum machine. The Trustee didn't say anything about them but he sure did give them a hard look when he mentioned that he just got discharged from a chapter 13. Probably another reason for the recommendation to chapter 13 this time around too.

    Don't know what that guy was thinking... walking in and being all loud with a gum smacking chewing wife and with diamond earings dangling to his shoulders.

      Sleepless,

      So glad all went well for you today and thanks for sharing your experience. I have my 341 on the 28th of this month and am getting more nervous by the day. It helps so much to know that if you go prepared and are not stupid "diamond earrings dangling".... then all should go well. Hope you are not so sleepless tonight

            Now wait out the 60 days till discharge and then start rebuilding your credit score.

                Nervous about 341 meeting

                I filed ch. 7 on October 14, 2005 so my 341 meeting isn't until December 20, 2005, what a great Christmas gift that would be. I am just very nervous I don't have any assets besides my car but I am just nervous. I am afraid that the way my expenses are listed may be questioned. If they feel you have more disposable income can they make you accept a chapter 13? I just don't know what to expect. I listed 401k loan repayment as one of my expenses is this questionable? Please help I'm biting my nails.

                  Newstart -- did you have a lawyer? I would say that the 401k loan repayment would be questionable on your expense list. My husband had a 401k loan that the lawyer told him to stop paying immediately because the trustee doesn't want to see you paying back "yourself" but not paying your creditors. How much is your 401k payment/month?

                    He asked to see my 2004 returns. That is because I am self employed. I pay taxes every year so a tax refund will not be an issue for me. But the Trustee is welcome to pay mine for me if he wants.

                      Yes I did have an attorney that is why when I seen that information listed on this site I became concerned. I put the 401K payment and contribution down on my expense list so now I feel like I'm going to have a problem. Is there anything that I can do to amend this information or is it too late. 100 per month pay back and $140 per month contribution. I think I'm going to have a problem should I contact my attorney?

                        yes of course you should contact your attorney.

                        if you amend before there is a complaint then you look more credible to the trustee (if you have to add any other expenses that is)

                          I would definitely check with your attorney. He should have told you that would be a problem! Mine did just that in my husbands case. Said best to stop 401 contribution and loan repayment because Trustees don't like to see you "saving" or paying yourself back when you want to get out of paying your creditors.
