    Status on Pacer?

    Hello,

    I have been lurking on this board for awhile. I filed CH 7 jointly with my DH last week, Oct 12th. I just checked Pacer and it says, "Pending Status: Awaiting Discharge ,Awaiting Final Report from Trustee".

    What does the Awaiting Final Report from Trustee mean? Is that what happens after the 341 meeting?

    Also, I recieved the letter today with our 341 date/time and it just says to bring photo ID and SS card. I've read many posts of others who say to take the extra documentation of bank statements and such. I'm torn between needing to do this or showing up with just what is required. I guess I should go over prepared, just in case...

    I'm trying not to be nervous about the 341. I did my paperwork as best as I could. We couldn't afford an attorney, so we did it Pro Se. That makes me scared, but....nothing else I could do.

    Anyway, would appreciate a reponse to my question above.

    Bizee, I'll try and help. I just spent about 15 minutes going over all of my stuff that I copied from Pacer and everything else I received.
    There is no category on mine where I find...Status:
    I find the datess that my attorney electronically filed, the time and place of my 341, my trustee and today I recived a copy all of this mailed out from the court to me and my debtors.
    I can only assume that because you filed manually rather than electronically (only attorney's can do this), that due to the high volume of filings that it is being noted that you filed, but everything is pending until they can get to it.
    I don't think that it's a very big deal, but understand how much you can worry over these things.
    My advice...give them some time to fill in the blanks. They are confirming that you filed and that you beat the deadline before the new law. That is good. They're just backed up right now and realize that your 341 might not be scheduled as soon as normal. Mine was almost 2 months, rather than the normal 3-4 weeks. Best wishes, Art

      Hi Art,

      I'm trying not to worry, this is just so scary with no lawyer.

      I got my letter in the mail yesterday telling me that the 341 is on 11/8 at noon. I tried to do a search on the trustee but couldn't come up with anything except for his law firm's website. I don't know whether that's good or bad! LOL

      So, for now, I will be (or at least try to be) patient.

        Here it goes: Awaiting Final Report from the Trustee means - whether or not you have any assests to distribute - excess that is -
        You have received notice of your 341 - take bank statements, pay stubs, tax returns for at least 2 years, proof of insurance, photo id and ss card. You can never be to prepared, if he doesn't need it, well it kept you busy. If he does need it you will have it and then you won't go in the dt's when he asks for it. It is so much easier to be prepared. DO NOT volunteer anything either. If you don't have something he wants, he will give you 10 days to 2 weeks or so, but you really don't want that, it will give him time to re-look at your petition.
        Good luck, stock up on the pepto and valiuum and remember "This to shall pass." I have been there and done that and I know all the ups and downs intimately.
        I'll be watching, you may never know when or how, but I'll be there. I am there now....

          "Awaiting Discharge" - means you have not been discharged yet.
          "Awaiting final report from Trustee" - means the trustee has not filed his final report in your can and asked for the case to be discharged and closed.

          Since you have not had your 341 meeting yet neither of the above will take place yet..... It just tells you what is coming up or has not been done on your case yet.

          Next is the 341 meeting of Creditors - seldom does any of them show up... After the meeting Creditors have 60 days to object to your discharge. If no objections the trustee will file for your discharge and then file his final report.

          Hang in there, be patient, let the process continue.... you have "just filed"....

          Average bankruptcy takes about 4 months to complete..
