    Dell Financial - Letter from Collection Agency

    10/12 - Filed BK.
    10/14 - Dell collection call - told them of BK, lawyer name & #.
    10/22 - Received letter dated 10/18 from collection company collecting on behalf of Dell.

    Is it possible they sold the account to a 3rd party after being informed of my BK? Is this a violation? Should I contact the collection company or Dell?

    It is more likely that the account was in a batch of files on its way to a collection agency already.
    Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

      As long as you listed the original creditor, which is Dell Fin., I wouldn't worry about it.

      We had a collector(who wans't listed) call us after we filed, they were call on a medical bill. I got worried and call our lawyer. He said don't worry, doesn't matter who they sent it too, as long as you list the original creditor. I called the collector and told them, but I said "I filed on 9/29/05 before you got the debt.", they weren't happy but what could they do?

        Had the same problem, (not with Dell) but the creditor sold the account or sent it to a different collection, they do these in batches, just call the company and notify them of the case number, keep a record of who you talked with, that type of thing.
        I'll be watching, you may never know when or how, but I'll be there. I am there now....
