    351 meeting today Texas

    Had mine and it was nice to be done with, I Hope.Went early and sat in on 6 others, no big deal most we relived it was over.Hoped for the best and expected the worst. No big deal but we're all afraid of the unknown.Cancer put me in hospital for 4 wks last year and no work for 8 weeks after , ran up a lot on credit cards, just living now and ready for a fresh start. Thanks for the input and sharing your stories made it easier. Look forward to 12/27/05 I hope.

    I think you mean a 341...not 351....but yes now you play the waiting game. Sorry about your cancer...hope you are feeling better. Good luck...Keep us posted.

      Mine is the 28th in Dallas. I'm trying not to be stressed over it, but then I read some of these posts about getting turned into Chpt 13, or not being discharged, and I start getting palpitations. Hopefully, it will go as smooth as most everyone says though.

        I was very wooried as well but all went very smooth. I saw a man with1.5M in sales last year and now only 45k in sales threr as well in chapter 7 and all went his way. did you file or have an attorney? goodluck

          txfencer, what all questions did they ask? Did they ask for tax refunds on 2005 taxes? What area are you from? I'm from Houston area and just kind of curious what all they asked ya..............

            341 questions

            My lawyer asked the first questions, she gave me an advanced copy.After the questions were asked ,the trustee had his turn, asked questions abiut the amount of money going thru my account, what kind of buisness i'm in,and looked at his computer a lot.He had our files on a laptop, fliped thru the figures and the like. After what seemed like a long time , really only 3-4 minutes, but seemed long, said he had no further questions said good luck and promptly took a break. I sighed a big relief, and my attorney smiled and said i was free to go home.hope that helps. good luck to you all as well.

              He did'nt ask about refunds from anyone i saw.I watched 6 or 7 cases and that was'nt brought up.He mainly asked about why they were there, or why the expenses or check amounts before filing. Mainly questions about what they had listed on the paperwork filed. Again hope this helps, just be honest and don't worry to much, all is fine, He cant eat you , yaa know.

                I have an attorney, but I'm worried about a payday loan I took out about 2 weeks before filing. The company that financed my vehicle was threatening to come get the vehicle that night and I knew even if I could come up with the money to get caught up, that it was only a temporary fix. So I took out a payday loan for $500 to put on a down payment on a used Dodge Neon after I got approved for a loan for $200 less a month. Well, of course, then I couldn't afford to pay the pay day loan, and my attorney said to stop payment on the check and add it to the file. So now I'm worried that it will look like fraud. I would be sick if the whole thing was thrown out over that.
                Then of course, after I had already bought the other vehicle and told the original loaner to come get the first one, they suddenly were offering to help me refinance, but it was too late.

                  Sorry for your problems, but i understand, I did'nt see any of this at the meeting, many had problems and discussed them with their attorney, bringing it up before the trustee had a chance so it was self expalined.I had a house that i gave to my parents to payoff and keep but never changed the name on the deed, no problems.Just be honest and truthful. they can smell a rat and see the truth.

                    Well, and I guess if it wasn't a big concern he wouldn't have told me to do that. but if it's a problem, hopefully the trustee will understand. If they disagree, don't they just make you pay that one debt off or does it affect your entire discharge?

                      I think you will be fine with the payday loan..I did the same thing 4 days before filing b/c I didnt have any rent money. I dont think they'll question you on it. I included it in the BK and my attorney said that was fine. I think the law is anything well over 1,000, spent unusually, is what might cause a red flag..but mostly from that is cash advances off credit cards, stuff like that. so dont sweat the 500, when you have other debt that's way more than that right? Plus the trustee will not look at when you took the payday loan out. All he will see is that you cant afford it. Hope that Helps!

                        It does thank you! I had my 341 this am, thank God it's over. There were only about 5 other people there, and no creditors. He only asked for SS card and DL. He did ask me why, since I'm a nurse, I had such a big cut in pay, and I was worried he would have a problem with the fact that I'm in grad school, but my attorney told me afterwards that it would be a discharged no asset case and not to worry about it. I can't work full time till I'm out of school in 3 years and I can't go part time in the program either because the Army reserve is paying me to go to school (so if I were to back out I could go active duty). but my attorney said not to sweat it. No other questions were asked other than the usual (why did you file, do you have property, etc). Hopefully this will all be over in Dec!

                          egul105 -- At the time you took out the loan, had you been planning to file bankruptcy? I think that is the test. Maybe this will slip by and you will not have to face that test. The lender/creditor can file an objection or a "proof of claim", and then the debt could survive the discharge... maybe... Does that right expire at the close of the 241, or at discharge, or a year later??? I'm not sure. Ask your attorney and let us know? Hopefully, you're done with it!

                            Well, I was in the process of paying my attorney so we could file. I didn't do it planning on not paying it back although I have no proof of that. I was expecting my first army check and thought I would pay it back then, but it was 30 days late getting to me and I didn't have the money. The attorney tld me not to worry about it because the pay day loan places are so shady half the time that they don't do anything. They weren't at the meeting and have not contacted me since I told them I had filed. So I guess we'll see....
