    Will the trustee think I'm hiding assets?

    I have $60,000 in credit card debts incurred over ab 8 or 9 year period. Most of that went to "stuff," little things, relatively small purchases of items I either no longer have or were consumable.

    But, I only have about $7,000 in assets, pretty much all exempt.

    Is my trustee going to look at the difference between my debt and my assets and think, "Where did it all go? She must be hiding assets."

    I was honest on the forms about my assets; I really don't own anything that could be sold to make much of a dent in what I owe. I have a problem with spending money, obviously.

    Also, would it help my case (which I filed pro se) to explain at the 341 that I have joined Debtors Anonymous and am learning how to be better with my money?

    When was the last time you used any form of credit? Anything within 90 before filing will most likey draw attention.

    Only if he/she digs about your debt. Don't just start babbling and volunteering info. You want to shoot for Yes or No answers only.

      No, I haven't used any form of credit for over a year. No loans, no credit cards, nothing. I have *inncurred* debt from a few late payments on things like the phone bill, but not a significant amount.

        Just be honest with any information the trustee does ask, and you should be fine.
        Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

          That's good that you haven't used any form of credit in over a year. I mean it would look very bad if you charged up your Sears card with $10,000 and then filed BK the next month.

          So, as StaciMM said, just answer everything truthfully. Also do not volunteer any info. Don't go rambling off... stick with yes or no answers whenever possible.

          It will be over with before you know it and you'll be wondering why you were so nervous about it... everyone has gone throught that.
