    Discharge taking FOREVER... Central FL

    Chapt 7 filed: June 22, 2005
    341 Mtg: July 29, 2005
    Last Date to File a Complaint: Sept 27, 2005

    Today's Date: October 28, 2005. Approx, 3 months after my 341...

    341 went without a hitch.
    No Complaints filed.
    Pacer showing no changes over the past month.

    Have called attorney three times this month for a follow-up. Was told that because of the change in BK that a lot of discharges in Cental FL are being held up due to the amount of filings going on prior to the deadline. They are also having some problems with their electronic reporting so PACER may/may not be updated.

    She sent an email to a contact of hers within the agency/dept yesterday. Told me to wait until the end of this month, which means this Monday...

    Anyone else running into this in your world?

    I am SOOOOO ready to put this in my rearview....

    Finally....

    Attorney called this am to let me know he rec'd the "official" discharge letter today and it's dated November 4th.

    Just a follow up to let all of you know, courts are backed up and it might take you some time to get yours... according to my attorney, Central Fla is wayyyy overloaded....

    My best wishes to all of you for a "speedy" discharge!

      We had our 341 on 10/31/05...our laywer said discharge usually comes in the mail after 60 days....HOWEVER they estimate it to be around feb 06...due to busy court system (Illinois). Hopefully it won't be that long!

        We filed 06/13, 341 last 07/20 and last day of objection 09/20. We still haven't received our discharged papers either. I checked pacer and it's not updated either. I'm in Central District of CA. Maybe ours is coming soon, too. Thanks.

          I'm in central CA district.

          I had my 341 on October 4th. And I've been worried that Pacer wasn't showing the Trustee's report from the mtg. Last friday (November 4th) Pacer was updated with a motion from one of my creditors to receive everything in the mail. The file date for that was September 16th.

          I'm less worried now and I'm just attributing it all to them being insanely backed up. I'm guessing that since the new law deadline has passed, as well as time for updating emergency petitions, they'll very slowly begin to get all the paperwork into the system. Based on my account, they're at least seven weeks behind.

            I too am still awaiting discharge and am getting pretty worried. At least there is comfort in knowing I'm not alone.

            My BK Court is the Central District of California. I filed on 7/13, my 341 meeting was 8/18, and the last day for objections was 10/14. To date, I have heard nothing but I guess no news is good news. The last date of entry on PACER was 8/18 where the trustee filed his final date of no distribution.

            The courts are backed up, I'm sure, but I sooooo want to get this over with!

              Central Fla was having a problem with their electronic filing so Pacer wasn't being updated. I again would imagine this is more due to the number of filings as opposed to anything else. YMMV.

              I would highly recommend that you contact your attorney when you get a few weeks beyond your "last date of objection". Reason being... I envisioned a "STACK" of these filings on the judge's desk just sitting there waiting to be stamped. I wanted to get mine to the head of the line, more or less, so I could get on with my credit clean up. Like anything else involved with this stuff, if you don't continue to follow up your at the mercy of someone else.

              My attorney was able to get in touch with his contact there at the court and I don't know what all he did, but I'm sure he brought their focus to my records, as within a week or so of that I rec'd my discharge.

              All in all, mine took about 90 days or so from the 341 and I would guess that as the year went by, filings increased so your time may increase as well.

                I still haven't heard on mine either. My last date for objections was 10/19. I followed the suggestion here to call the trustee and left a message on his voicemail, but never heard back and still no change to Pacer. So still waiting.

                  you can always try calling again. but i wouldnt leave another message. dont remind them that you already left a messge. start anew and ask if your have received the discharge and if they would be able to enter it with the court.

                      My advice, don't call the Trustee. Just wait it out, I learned to stay away from him!

                        your not alone. I filed in july, meeting was in augest and deadline was 10/11 and i have not herd a word.

                          You will get your discharges. In my case, an oddity, certain deadlines went beyond the discharge date. The Trustee wanted to make sure that no one would want to set aside the discharge and come after me. For me real closure came when the case closed. My case closed one year ago last tuesday. My discharge was in May 2004. Do not take on a new "case closed" worry now that I've said this. In 99% of all cases the discharge closes the case.

                          I considered many means to end the hellish nightmare I went through, most of them involved me becoming a sniper and would have landed me in jail. Those thoughts were pushed aside as soon as they came in. He even wanted to sieze my 22 Rifle at one point! I would have surrendered it since it was a BK and not a Constitutional matter.

                          was the Trustee wrong? Nope, just doing what he should have done to make sure.
