    341 and supplemental income

    Here is the situation. Even with filing bk my income is too low and I need to buy some new tires and have some repairs done to my vehicle that I've been putting off for months. I filed Ch 7 on October 15 and I applied for a seasonal position at a shipping company recently.


    I just got my notice of the meeting of creditors that is scheduled for November 21. I also just heard back about the seasonal position today. They have me classified as a temporary seasonal worker with an end date of Dec 30, but they said I could stay on after that if I wished. Not sure if there will definitely be a job after that or just potentially.

    I told them I may have to wait a week or two before I can start. However I don't know if they'll hold the position for me until November 21.

    Should I just try to hold off on accepting the position until after the 341? Or could I possibly accept it a week or so before the meeting since I will be probationary and probably won't get paid for several weeks?

    It's a great opportunity and I really need the money for car repairs, etc but I don't want to get in trouble or converted to a Ch13.

    my opinon is that you should ask your attorney. he will explain everything.

    also, if you get the job does that put your income greater then your bills?

    if yes then dont take the job imo. this is a Federal case. they don't mess around.

      I did speak to my lawyer she recomended waiting until after the 341.

      How long should I wait until after the 341? This a great chance for me to make some money to pay for some repairs I've been putting off for almost a year. If I miss this chance I'll have to accept something that pays about half of what this position does.

      If I started the job a day or two after is that pushing it?

        My lawyer said it's best to wait until after the 341. But I've seen some people say it's best to wait until after discharge.

        I am currently working full time now making about $29000/yr my wife does not work. My disharged debt will be just under $20,000.

        Is it likely the trustee will be looking at me with a magnifying glass?

        Another issue is if I perform well at my current job, I will receive a $5000(gross) promotion in about 7 months. Is this something that could force me into a 13? I raised the issue with my lawyer and she didn't seem concerned.

        It really sucks to file bk and still be broke.

          if that $5000 is guaranteed then i think you are safe if its 6+ months away.

          anythign can happen and they only seem to look for sure cases of cash.

          thats why no one should change their works status until after 341 at least and imo until discharge.

          what happens if trustee wants to look closer. you are screwed. what happens if a creditor objects to your expenses, etc.
