    Signing papers Monday

    Well, we are almost there! Meeting with our atty on Monday to sign the final petition. She hopes to have us filed by the 15th at the latest. She said it takes about 2 hours to sign all the papers, does that sound right? Hopefully this weekend my husband and I will be able to do our counseling course online. I was just wondering though, if our discharge doesn't come before Christmas, are we still ok to buy Christmas gifts and things like that for the holidays? It is already going to be a very small Christmas present wise, but I want to be able to get a few small things for my kids without the fear of repercussion from the trustee. Hopefully we can get our 341 before the end of the month, but I just don't know. Our attorney said we have a very simple case so that is my hope. Thanks!

    We just signed our papers on Tuesday. It took about an hour and a half to finalize everything. Our lawyer told us that we can buy for our kids for Christmas, no problem. I don't know how much a trustee is really watching your spending after the 341. Maybe someone with some experience here can answer that.

          I don;t think your trustee is watching your spending for any date after the close of the last bank statements you are required to submit.

          In MN, you submit bank statements at the 341 that cover the date you filed (in case you had 10 grand in your accounts and lied about it, I guess!). For me, that is September 9th. So, my primary checking account statement covering that date closed on September 19th. My previos checking account closed as of September 8th, and my HSA had about 140.00 in it on my filind date.

          I was told that the trustee would not care a bit about anything to do with my account activity past the date of filing. Though I imagine if he saw a 20,000 deposit or a 9K shopping spree, he might ask about it at the 341

            After you file and if you are a 7 which I assume you are you are allowed to live. Buying Christmas is fine. What they will look at is your bank statements before filing, so unless you have some large sum of money come in after filing, or there is a presumption of abuse, you are fine to buy the kids xmas. I would imagine you will have had your 341 by then and will be edging close to discharge and close. Good luck!
