Discover Card refuses to reafirm, says they don't for anyone.

I am so frustrated. I have my 341 hearing tomorrow and Discover Card has now gone after my daughter. Yes her name was added to the account years after I opened the account. Now they are saying I have a zero balance and she owes everything. I have tried since Mon this week to get in touch with my attorney he has not called me back until today. I called them myself yesterday and they refused to talk to me at first because they say it is not my account. Then when I finally got through to someone they say they do not reaffirm any accounts. Does anyone have experience with Discover Card? My attorney finally started trying today to get through to them but says he has had no success with anyone returning his calls. Can they just take my name off the account and go after her. Should she get her attorney to call them? Will this affect her credit? Thank you for any help you can give.

Most cc companies do not reaffirm.........most stop usage immediately after notification of bankruptcy.

If your daughter is a "authorized user" I believe that she too can be held responsible also. Kind of like she's the user, your the co-signer/owner of the card.

Will it affect her credit, probably will show up on her credit report as:

Discover Card - authorized user, included in bankruptcy.
Yet she will be responsible to see that its paid.

Thank you Minny, you always come through for us. I guess you are right. I am going to try to get through tomorrow and then work with my daughter to get this behind her too. I talked to her and she said she will talk to her attorney first of the week. Thanks for the reply.

Keep making regular payments on it (your daughter) and should not affect her credit report or pay it off entirely.

Just make sure YOU don't pay it off.......that's special treatment to an unsecured creditor..... over others.

Hello - what I meant to say is let your daughter make the payments now - not you!! Till is paid off!! Then won't affect her credit report.

If she is truly just an "authorized user", she is not responsible for the account. If she's a cosignor or co-applicant, then she is. Discover is tough, though, and will probably try to get it from her, even if she's just an AU. Also, she can have it removed from her CR, but again, I would suspect Discover to be "difficult". You can find lots of info along these lines by searching the internet.

Did you add her as an authorized user or as a joint account holder? If she is an authorized user, she is not responsible. If she was added as a joint account holder (responsible for the debt) then she does owe it. Your BK discharges your obligation, but not that of anyone else who is responsible for the accounts.
Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
