Thanks for that definition. I've never heard of such a thing. Now we had a motion to have a Trustee hire a lawyer and then we had a simple in the lawyer's office interview. It was a 2004 in which we paid back our god-daughter's loan.

The final compromise was that I would pay in six months when my retirement annuity would be due. They accepted for less and all is well.

I'd love to get my grad degree....but I don't see how I could justify going back for it at this stage of the game.....my fantasy was always not only to do my graduate work, but post-grad as well......I had a kicking thesis that I always thought would be perfect for my doctorate.

The saab is a luxury convertible, a fully-owned leftover from my former high-salary life. I moved to Michigan which is not convertible-friendly 10 months out of the year. I wanted a new, reliable "student" car because I have gone back to school to get a second graduate degree.

The funny thing is that the trustee did not mention this year's tax return at my 341, although he made a big deal out of how large last year's tax return was. In my district taking tax returns is not automatic, although the trustee can simply write up something and make it an asset during or after the 341.

The car in question is a 2004 saab convertible that I exempted but there was a transfer involved when I bought a new Hyundai Elantra. The trustee is looking for a way to negate the transfer and get some cash out of the situation even though I exempted the car using my federal car exemption and part of my wildcard exemption.

I think this is what's probably happening to me - TT has filed the motion to retain counsel, and my case has been changed on pacer to an asset case.

I know he wants my tax refund for '09 (stated that at the 341 en masse to all assembled), but the lawyer is probably because he wants some funds that passed from me to my fiancee last year.

I can only hope that I'll be able to make a deal with him for a payback on that (suing my fiancee would be useless - as he has less than I do, and I've got diddly squat).

My status hasn't been changed yet on pacer as an asset case, but I am sure that is coming.

I think the trustee is still trying to figure out a way to get some money out of my car too. But I am certain he will want my next year's tax return. at a minimum.

I'm Western Michigan. This trustee is from way up north actually by traverse bay.

She was a homemaker, and the trustee (a female attorney, likely pi**ed that some women don't work) found some precedents in other states where a non-earning homemaker isn't entitled to exempt 50% of the return.

My attorney was about to fight it, and had a worthy argument, but his costs would have equalled what I'd get back. ...and the trustee knows that. We settled for 25% of the return, written on a check rubbed I rubbed on my dog prior to mailing.

If I weren't broke, I'd have had no problem pursuing it for 2 reasons:
-Spite: I like to call bluffs as a matter of principle.
-Precedent: I'd love to have set a precedent that helps people like me in the future.

Thank's 'hub. I think it's the tax return and possibly he is still going to try to give me grief about my saab. That is all it could be at this point.
