I have tried to do the research on this so-called "Chapter 20".
We own a condo (underwater) in the state of Washington. We finally succeeded in getting 1st and 2nd mortgages modified, and are current. We are, however, behind on association dues. Today we received a letter stating from association attorney stating we had 30 days to make arrangements to pay the $6700 that we are behind (about 11 months).
We are in the process of filing for a Chapter 7 to discharge unsecured debt in the amount of $250000 (personal taxes that meet the requirements). Once this debt is discharged and behind us, we should be able to make the regularly scheduled PITI payment and association dues.
My question is this twofold: if we file the Chapter 7 shortly (within 30 days), will this stave off the condo association foreclosure until the Chapter 7 is complete, AND then can we file a Chapter 13 the day after the Chapter 7 is discharged to make payments on the association back dues (I realize the Chapter 13 cannot be discharged for at least four years).
(ALSO I UNDERSTAND THAT CONDO FEES CANNOT BE DISCHARGED, AND THAT I WILL HAVE TO PAY THEM).
