Due To Pressure I Filed Personal B/r Prior To 10-17-05 W/o Knowing All Of Code Of New B/r Law. Now, It Appears Beneficial If I Could File Under New Code. Is It Possible To Get Court To Set Aside First Filing And Replace It With A Filing Under New Code Since It Would Be More Beneficial Given That The Purpose Of A B/r Is To Assist A Debtor With His Debt Control?

You can always get it dismissed. Just not showing up for the 341 will cause it to be dismissed, but you still will have claimed. Isn't there something in the new law about not being able to claim if last Bk filing was less than 3 years? You really need to check this out with an attorney.
For one thing, you wouldn't get your $209 back, at least I don't think so. And you'd have to pay the new higher court fee.
