    Question re CC's, home loans, etc.

    I'm sure this question has been asked and answered but since I haven't seen any threads on it, I'm gonna ask again.

    Our case is over a year old (dismissed and refiled) and we are currently under a motion to dismiss by the UST with our first hearing coming up this week. As many of you know, we did not go BK on CC's (6K total). It was because of a lawsuit brought on by my father.

    We have been receiving some interesting solicitations in the mail lately. Some of them from car dealerships that will deal with BK's. Some for CC's and home refinancing. After I sorted through what was legit and what was crap, I came up with one CC that knows about the BK and will up our credit limit each time we pay on time. The other two that intrigued me were for home refinancing (HUD, FHA) with great interest rates. These two also seemed to be aware of the BK. One was from our current mortgage company.

    My question is this, am I ill advised to apply for this credit card while our BK is in limbo? We never used many CC's but I would like to start rebuilding some credit and have something in case of emergency, like car repair (car is 9 years old).

    Also, can you refinance while in BK? I thought you had to wait 2 years after discharge. I would love to refi at the rates they are advertising.

    Probably a pipe dream but I thought I'd throw it out there and see if any of the above is possible. Also I wanted to make sure we wouldn't get in trouble for applying even if we are turned down.

    I would not obtain any new credit until your discharged. I hope you win your case!

      Thanks aces; I hope we win too. Can you tell me why it is a bad idea to obtain credit now? Would we be breaking some sort of BK code or law? I don't want to do that!

        Our attorney told us that you are not allowed to obtain new credit until after you are discharged. Maybe one of the other forum members can elaborate on that.

          Thanks again. I noticed in you signature box that your case was also under a motion to dismiss by the UST. Glad to see you were discharged! What issue did the UST have with your case and how did you resolve it?

            Ours was income. Somehow our attorney used the wrong figures and it ended up looking like we had $1500 a month in DMI. We didn't we actually only had $15.00. Took a while to prove it to him though.

              You cannot obtain new credit after filing, until you are discharged, unless you have the permission of the trustee.

                Thanks. I didn't know the trustee looked at that kind of stuff. We have been in limbo with our BK for sooo long I was hoping to start what resembled a "life" again, but this too shall have to wait. Thanks again for your time.
