hello all, is there a time limit for amendments to your petition? as i said in a different post my attorney made several mistakes on my petition, one showing we make more money than we do. another question would be, if you show any disposable income at all would we have to convert to a chapter 13? is anybody else having trouble getting their attorney to answer their questions?

you need to file amendments as soon as possible. the trusttee uses that to make decisions and if you file them to late then your case will be prolonged.
they have to be filed by the time the 341 comes or the trustee will say "any changes, is it correct, etc?" and you will say "yes" and the trustee will then tell the tatorney to change it and the trustee will have to consider the facts again.
anyway, take the chages needed and the paperwork and go to the attorneys office and site there until it can be done for you. take a lunch bag
Im not an attorney or a trustee. You cant trust me either though!

I am having a problem with my attorney answering my questions and giving me any legal advice to tell me what is in my best interest. I feel like my attorney is working with the creditors.Originally posted by jal592hello all, is there a time limit for amendments to your petition? as i said in a different post my attorney made several mistakes on my petition, one showing we make more money than we do. another question would be, if you show any disposable income at all would we have to convert to a chapter 13? is anybody else having trouble getting their attorney to answer their questions?Discharged 2/27/06, closed 6/1/06

one thing i noticed is the attorneys will report anything you mention to them and they are not allowed and won't let you lie on the apps. mine were very upfront about this before they even let me say anything. it works for me since i think its always the best policy to be honest about anything. keeps it simple like that.
this may be what you are 'feeling' from your attorney. they probably are not working with your creditors. although i don't know that for sure. i guess they could be dishonest. but if your attorney isnt advising you to pay them off then i doubt it.
go get second and third and fourth opionions, they are free and will answer all your questions.Im not an attorney or a trustee. You cant trust me either though!
