creditor calls before filing chapter 7/attorney question

If you tell them to call the lawyer this month, will the the creditor sue me if I file in February? Basically, I'm waiting for my tax refund so I can be current before filing. Currently not paying CC for three months now and have gotten used to their calls. My main concern if the CC sue me first before filing. Thanks.

I plan on filing in December, but I might need to wait until February. I'm not really to concerned about getting sued. My attorney said we'd be OK not paying and waiting for 6 months. So far I have sent a DV letter to both Capital One & American Express.
