We were due for our discharge on 11/14, but I noticed it was signed and entered on Pacer yesterday....now I am waiting to see the order listing the creditors etc......I know that happens usually when the case is closed, at least that is what happened with my in-laws.....

tax refund
I just filed bk7 on october 16,2004 and have meeting of creditors on feb 8, 2005. Will they be able to take my 2005 tax refund if i have not done it yet? Most of it is EIC and child tax credit. Also, can I file before the meeting cause we need the money or should I wait? Any help would be appreciated.

if you havnt filed it then yes they can take it. but it depends on if your trustee takes those or not. some do some don't.
also, i have the feeling they could take it even if you already got it back maybe. probably harder to do but make sure you can account for and document all the needed things you used the money for if you use it

All right..... so I check PACER like a maniac, and not only check my case, but check several upwards and downwards by case #.... It appears as though everyone who's last day for objections was the sameas mine11/14,has received theirdischarge yesterday.... I and several others with the same attornery have no updates to our cases. My next mission was to find out why, based on the information in PACER. I think I may have found it. Under 'Case Summary' 'Filing Fees' the note indicates INSTALLMENT as oppose to PAID like everyone else. However, there was no 'INSTALLMENT', I paid everything in FULL prior to filing,and there is an entry in the docket report for auto payment $209. I'm wondering/hoping that someone keyed that in wrong, and given the automated discharge process (provided there are no objections,and fees are paid) the system bypassed us thinking there may be money due on account. I plan to call the Clerk's office today, but as you can imagine, I have bags under my eyes bigger than Santa's sack of presents from worrying about this all night. I'll let you know how I make out, but if any of you have any experience, info, comments about this, please share. Happy Thanksgiving.

Yes, contact the Clerks office and see what this "filing fee" is for. Shouldn't be on listed there if you paid everything up front in the beginning.

PACER....this is ok for the public correct. "P" stands for Public and the site gives one the tone that you need to be working for a firm to access anything. Anyway I did access it and was thrilled to see my discharge went through the 21st! If someone can calm me down knowing that accessing the site is legal! -- I'm positive it is......just anxious after all this waiting etc. Thanks. RALast edited by RA777; 11-25-2005, 01:49 PM.

It actually is highly legal. If you remember when you first logged on it said if not a firm, enter your name twice.
You are also correct in the PA stands for Public Access.
You're in like Flint! (unless you're old enough to remember that expression!)
