    Need help ASAP

    We filed on 10/13 and had our 341 meeting on 11/18. We were never sent any reaffirmation agreements by our mortgage company. We are current with the payments on the first mortgage but we are behind with the 2nd mtge. The reason the we got behind on the 2nd mtge was because we had enrolled on an automatic payment plan that we though they would automatically debit our account every month. What actually happened was that it was an on-demand payment, so that we were responsible for going online and making that payment every month. We only found that out after it was 3 months overdue. We made that payment on 10/07 and were caught up. We called GMAC up and they said that our payment went up because the rate had changed and we were a bit confused about that. A couple of days ago we tried to go online to make the payment and our account was locked up. We called them up and they kept us on hold for 2 hours and at the end of the second hour and after being transferred several times they said that our account was sent to the collections dept and that there was no one there that could help us. We are very scared that they are up to something. Can they take the house away from us?????????

    Try to get in touch with someone higher up at the 2nd. Let them know you would like to resolve the account. I suppose they could press the issue (after BK) but to do so wouldn't make a lot of sense as the 1st mortgage would be paid first, so if you have little or no equity they wouldn't get their money.

    Call the 1st mortgage and ask them to send a reaffirmation agreement. (If that is your intent.)

    For future reference, keep a closer eye on your bills, etc. If you don't know that the payment isn't coming out of your checking account and you don't know this for several months, you will continue to have money problems even with your unsecured debts gone.

      Because of the automatic stay, they can't bill you right now and generally that means online access is turned off also. You may want to ask for which ever department handles BK accounts when you call in-it may be a different address to mail payments to.
