Credit Union / Car Situation

I owe on two cars with my CU. I am two to three months late on payments. I filed a month ago. My BK stated that I plan to reaffirm the cars. My atty told me I would have until that reaffirm deadline to make the decision to reaffirm or give back so I am driving the cars and will probably give the cars back just prior to the deadline.

My CU has contacted my atty and wants to know my intensions. They can't reposess the cars can they? Am I thinking clearly with regads to my plan to keep them until my deadline? Am I affecting the outcome by not making payments while I keep and use the cars for this period of time?

They cannot repo your cars until the stay has been lifted. They can ask the Court to lift the stay, and the Court will allow this unless you reaffirm. However, until your discharge, you can recant your reaffirmation. After you are discharged, you are stuck. I would simply be honest with them and let them know. Make other arrangements and go on from there. 'Hub
