    Hi, I'm new, I filed; can I get some advise?

    Hey new to the forum. Man this is nice to have some people tell me how it is.

    My wife and I filed for 7 before the deadline. I've lost my job. Its how my profession goes, pretty cut throat.

    We filed for 7 and have our meeting witht he trustee at the end of December, 1st one. We're pretty close to a 13 but without me working we qualify. Our attorney seems pretty good.

    Can you explain the course of action after our meeting. What happens if I get a job after the court date?

    I'm not sure about the job issue, though I'm looking as well and had my 341 this past Monday, so I'm anxious to hear about that.

    As far as what happend after the meeting, you just lay low and pray no one objects. If there are no problems, you are discharged in about 60 days, give or take the back-up in the courts.
    Filed CH7 - 10/13/05;
    341 Meetings: 11/28/05, 3/20/06, 12/4/07 (3d time's a charm!)
    Converted: 2/15/06 (to CH13), 10/15/07 (Back to CH7)
    DISCHARGED: 2/15/08

      I've read that what happens after your file date is not relevant, as long as your income reported was accurate at the time of filing. But then, I've also read that if you're 'looking' you should hold off. Probably best to ask your attorney. Some things vary by district and trustee. It might also depend on how long your unemployment went on. What I mean is if you were laid off right before you filed, and got a new job right after that would seem more suspicious (I think) than if you had been out of work for a little while.

      With the new laws, your income is based on the last 6 months so I think it tries to prevent someone from taking a work-hiatus just to file. (NOt saying you did that-just my 2 cents worth!)
      Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

        I have heard the same thing Staci...all they look at is what was going on when you filed and not what transpired afterwards. However, when our case was challenged by the trustee she checked everything spent and done from the start to the time we met with her. Still I dont think a job should be a problem because you have to work......

          you cant choose to get laid off. but you probably mean quit work. as to the point being made i beleive from what ive read and heard getting a job or making more money due to a raise which would put you into a chapter 13 is way too risky period. now doubts, hands down, dont do it, etc. ask any attorney. its just not worth the risk if it happens.

          should it happpen? no i dont aggree with anything that happens after your filing should be taken into consideration. do they? they say they dont! ROFLMAO.

          but they do and can so be very careful to anyone reading this that if it does happen that you make 5 times as much aftward then you might be forced into a chap 13.
          Im not an attorney or a trustee. You cant trust me either though!

            The Trustee is most interested in what circumstances are between the time you filed and what has changed when you have your 341 meeting. Now if you have a windfall - get ready to pay the piper.

            Getting laid off may work towards keeping you in Chapter 7....
