    My 341...

    I know everyone here has read plenty of 341 stories, but especially for those of us who haven't had theirs yet, these are a big deal as it was for me to read before I had mine. So, had my 341 yesterday. Group session, trustee addressed each one of us individually and asked a portion of the standard questions that he felt most relevant to each individual case. What was getting me most nervous was how he asked every case before mine to surrender their tax return before they spent it. Once it was my turn, he asked the least questions to me of all the cases. I believe the 4th question or so was, "What is the reason for your bankruptcy", which I calmly replied, "When Citibank quadrupled my interest rates because of a late payment". His immediate response "This meeting is complete." Didn't ask or say a word about my tax return . I skated out of that room with the quickness, marched out through the hallway, stylin in my $20 outfit. Opened the giant glass door of the united states courthouse. Looked outside, sun was shining, heat radiated through the glass and a slight breeze from the inside of the building was at my back as if pushing me outside. I took a couple seconds to reflect on the moment. I remember thinking of the phrase, 'the first day of the rest of your life'. I knew it wasn't over yet, but I stepped out of that building with a confidence and stride I had never felt before in my entire life. And, to those who haven't had your 341 yet, take a minute, relax, and let the stress go. And for myself, please sign me up for the 60 day club.

      Congratulations on you 341. I know how you feel I went for my 341 yesterday and went partying last night. Paid Cash.

      I was interested in your comment about the trustee not asking about your tax return. My trustee asked folks in front of me to sign a document keeping their cases open until she received their return but didn`t ask me to sign anything and simply let me go.

      Not sure why this happen. Can only assume it is because I am paying the IRS for some back taxes and I guess they would grab it first anyway.

      Any comments on why we were not asked to sign anything?

        Probably so! If you owe the IRS back taxes then you're not likely to get a refund. If the trustee kept your case open, he'd end up having to do extra work for nothing.

        Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

          There is a certain amount of humour about all of this. Sorta like two great white sharks fighting over the same dead body.

          Let`s see who gets the last penny the irs or the trustee. So the best way to get your case closed sooner is to owe the irs.

              geez, i didnt have any moment like that at all.

              i left the 341 meeting looking wildly and uncontrollably for a pacer terminal. i was quivering like a wet, stinky, sick dog constantly looking over my shoulder to see if the trustee was coming after me with rope and shackles...

              Im not an attorney or a trustee. You cant trust me either though!

                I just checked pacer, and its finally updated. Heres the comments on my 341:

                Meeting of Creditors Held and Concluded on 12/1/2005. Trustee's Report of No Distribution: The trustee appointed in this case declares under penalty of perjury that the trustee has neither received any property nor paid any money on account of this estate except exempt property; has made diligent inquiry into the financial affairs of the debtor(s) and the location of property belonging to the estate; and that there is no property available for distribution from the estate over and above that exempted by law. Pursuant to FRBP 5009, the trustee certifies that the estate has been fully administered, and therefore requests that he/she be discharged from any further duties. (Smith, Alexander) (Entered: 12/02/2005)

                Lookin good eh? I think so. But does anyone know what this 'FRBP 5009' busniness means?
