    Do I have to file a homestead deed in Virginia if there is no equity in my home?

    i think you should file for the exemption...i just filed in calif..it cost 8 bucks...even though at this time you have no equity..it could change..more importantly it would deter creditors from forcing a sale IF and when you get equity...and you would want it BEFORE any possible abstract judgment...if you are not filing bk right away...its well worth the few bucks to have it filed...

      Hello ed: I deleted your other post as it is against the rules to post the same question in multiple boards.

      As to your question: if you intend to keep your home, no matter how upside down you are, you need to file for the homestead exemption. Here in Florida, we have to file every year between Jan 1 and March 30. Once you have done it so many years, then it becomes automatic.

      You really need to check into what your state has to offer if you have not.
