    Tax Return

    Today was the last day to file an objection. The trustee has already requested that she be dismissed from the case (or something like that) as she's ruled it a 'no asset' case.

    She did ask about our previous years tax return (at the 341) and a bit about the '05 return but since she ruled it a 'no asset' case will she take any of our taxes this upcoming year?

    Thanks for all your help.

    not if she dismissed herself. she is outta there.

    otherwise she wouldnt get to collect the money for herself. if there was anything she would stick with the case.

      I saw that she dismissed herself and called my attorney (around a month ago) and she said we were in the clear.

      For anyone asking I filed in the Sixth Circuit (Toledo, Ohio) and it was rather fast and painless although I was amazed by the amount of filers who decided to no show. The trustee looked very irritated with them.

        I don't get that either, but I guess there are some who file w/ no intent of going thru with it. Perhaps just need a little extra time to stall a foreclosure or something.

        Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
