Everyone here has been great, but I still have another question to bug you about!
My 341 was 11/21.
My 341 is over, and my 30 day deadline for objections is 12/20. My scheduled discharge date is 1/21/06.
My Trustee has ruled my case a No Asset.
My attorney said that I was able to get a new job (part or full time) now that the 341 is over.
This is where the mess begins.
My current employer is the family construction business, and we seldom have much work in the winter season. This year we have no work, meaning no income for me.
I have been searching and applying for a new job since the day after my 341, and still have not found a new job yet. Not even flipping burgers.
I now have almost nothing to live on, and not a cent to buy a Christmas Present or two for my family.
The problem is that Christmas is just 2 weeks away and I'm not sure what-if anything, will happen before then job wise.
Is there any way known that I could make even a few hundred bucks fairly fast so I can possibly purchase a gift or two?
Yes, despite how it sounds, that was a serious question.
I have one possible solution, if I am able to do it- and it's a big if too.
I have 3 cars, 1 was exempt, the other two- the Trustee did not express any interest in, and she has allready ruled my case a no asset.
I am considering trying to sell one of those cars fairly fast and use the money for a few gifts and basic living expenses. The money I would recieve from the car sale would likely be $1,500 or less, as it is an older car with almost 140k on it. I would fully document all receipts relating to "what was done with the money."
I asked my attorney about this at the 341, and he said that I should be ok to sell it now that the Trustee has ruled no asset. But, if I wanted to play super safe, that I could wait until discharge. I've played it safe most of my life, and now don't really have that option. Thus far, my attorney has been great, and has not steered me wrong.
Based on the Trustee's report of no distribution, what my attorney said relating to this matter, the small amount of money involved and what it is for, as well as present circumstances, I think that I should be ok in selling this car and documenting where the money was spent- which again, is only for basic living expenses and a few Christmas Gifts.
Do you folks here think that there would be any issues in doing this?
