Although the IRS Transportation Std for Vehicle Ownership is $489 per vehicle, my attorney said that the 9th District Court of Appeals recently ruled that if you own your vehicle(s) free and clear, you cannot claim this expense on the means test. We have two vehicles. If we can't claim them, we fail the means test by $900. I have no reason to not trust my attorney but if this is all that keeps us from qualifying for a Ch 7, I want to make sure that this information is correct. Is anyone familiar with this ruling?
