    341 Meeting, and questions

    I have my 341 Creditor meeting on Monday, I was just curious how long they lasted, and if I need any information to take with me. I am nervous. I filled alone (meaning not with an attorney), and don't know anyone who has filled. What goes on in this meeting what questons do they ask? Do they let you know right there if they rule it as a no asset case? are there other people in the room? any information or help would be apreciated.

    In Colorado you get a letter a few weeks before your 341 telling you what the trustee wants you to bring. Ours wanted social security cards, a couple forms filled out, 2 years tax returns, pay stubs for the pay period before and after the date of filing and bank statements showing the amount in accounts on the day of filing. I would not bring anything more than what the court asks for.

        Think about being a terrorist being interrogated by a foreign country. Think of being imprisoned in Mexico or Thailand.
        Then forget it, it is a total breeze. Out trustee was hearing 4 cases every 15 minutes and having to kill time between 15 min. sessions. I was the only one asked more than the standard questions. Answer yes or no. Mine was asking about collectibles. Well I have an 8 year collection (since it's inception) of a limited print magazine. Value depended solely on the buyer. Might be worth $5at garage sale or $150-$200 if I found the perfect buyer. I think we listed it at $25. Asked my atty just before we were called if I should mention it. Answer was, "No, we listed it on the petition, if he has any questions about it, he'll ask"
        The only forms needed are your Driver's License and SS card or some proof of your SS #. We received a form about a week before that we needed to sign, I think that it was confirmation of our names, address and SS #'s. If you don't receive anything, don't worry about it. They will either have it there for you or give you a day or two to get it in.
        Some say "no asset case" mine didn't say anything to anybody except Thank you. Well not to anyone except me. You can read my story under 341 meeting update and 341 semi-over. Even with that mine showed on PACER the same as the other cases the next day and I entered the 60 day club.
        Two suggestions...
        Spend an hour reading the posts starting with "341 meeting" There are about a gazillion of them posted in the last 2 months.
        Get there early. It's an open meeting and listen to what goes on in the cases before you. We heard prob. 12-15 cases in the 45 min. before ours. Really lessened my anxiety.
        Dress is casual. No cell phones allowed. Be honest, but don't overtalk. The most common non-standard question the day of our 341 was, "How did you arrive at the value of your house?" Practically any answer other than that's what we paid for it 30 years ago was acceptable.
        It's nerve wrackking for everyone. What you are feeling now is normal. I've read hundreds of posts re: 341 meetings and was still nervous, but like everyone else said, it was nothing (and I was one of the rare ones with a fairly significant issue who got 3-4 minutes of extra questions from the Trustee.
        BTW, leave very early. You do not want to miss this meeting or be late for it. Also the Trustee is (usually) neither the devil or your friend. You've filed at a great time. They are very busy and making lots of money just from hearing so many cases. Most are more forgiving and helpful if you filed Pro Se (without an atty) Best wishes and keep us posted. Art
