    Thought we were in the 60 club!!

    Well, I have been following these boards since we filed pro se October 14, 2005. Our last day for objections was fast approaching, January 6, 2006, and we were even beginning to breathe a little easier until I checked the mail yesterday.

    We received a letter from the US Trustee asking for 6 months of paychecks, 2 years of income tax, 6 months of bank statements, and asking if our 20-year-old and 18-year-old daughters live with us--they do and they're in college. Oh, they also wanted a breakdown of our car insurance premiums for each car. They were also questioning what a $220 payment was for that we listed as an expense--it's one of our daughter's tuition payment after her loans and scholarships.

    I tell you! I quickly deflated after reading that letter. We have until December 28 to get this stuff to her. And she wants a brief explanation of the extraordinary circumstances that led us to file bankruptcy. That explanation will not be brief.

    Anyway, nothing is noted on Pacer except that our 341 trustee had concluded his portion--so now the US Trustee (letter is signed by the assistant to the US Trustee) can have some fun.

    I had to chuckle at some of her questions because she had our groceries as $600 and wanted us to explain that but our groceries are $400 and I verified on Pacer and my copies, so. . .

    Just wanted to say for this waiting--don't breathe easier until the day after your last day for objections.

    I have almost everything she needs and will be copying all this stuff and mailing it all out this weekend. I might have hubby hand deliver it though since he drives through downtown to go to work. I am hoping she puts us out of our misery before January 6th. I know she's looking for money somewhere. Sheesh!! That will be like getting blood from a 1000-year-old corpse. We have nothing!!

    Just out of curiosity, after your 341, did PACER say that the trustee found no assets and wishes to be relieved of the case?

      No. Pacer just says that he has concluded his initial report. I had jotted down case #s when we were waiting our turn in the 341--everyone was pro se (25 of us) and all of them for this trustee say he has concluded initial report and 341 terminated.

        If you don't mind answering, what is your household income? I understand that the US Trustee is likely to ask for info if you're above the median.

        Try not to worry-just be honest and it should be ok!

          Our household income is 58176 including my husband's military retirement. I'm trying to be calm. I think when she sees everything, it will all okay. Just aggravating when you get so close and they snatch you back. I feel like I'm in the desert with a tall glass of water out of arm's reach. . .

            That's nothing unreasonable... Depending on the state, that may not even be above the median. Perhaps you're a random review.

              We're under the median income for KS for a family of 4. Median imcome is $59,498. I will keep you all posted.

                Sounds like your US Trustee is really applying the new laws. They usually average the last 6 months of income and include all household income including a 17 year old working in a convenience store.


                The best advice is to take the means test form b22 just to see if your expenses are in line with what they want. If they are in line then despite the dreadful letter you should be fine.
