    I think the trustee is messing with you; he knows you filed pro se and you are without an ally. He is trying to get you to fork over money. Don't fall for it; let him have the truck if he wants it. He doesn't want it. You can always arrange to make it good with your mother later, should he do this; and there are ways to get vehicles with redemption statutes. So, don't cave in.

      i wouldnt just let him have it exactly if you want to keep it. of course paying the 1400 in payments worst case might be better for you.

      but, work it first. i would send him a letter with Exhibits A, B, C, etc showing him the vehicle pic if its looks bad (hehe) and the supporting things that are wrong with it, be honest and dont go overboard but list everything - including repair estimates if you have them, and show the printouts of the vehicle price that it is going for in teh newspaper, auto trader, online, etc.

      do this is you can make a case its worth less. dont give him any evidence that its worth more. make it to your favor.

      keep in mind that i am unaware how this process should work. so i dont know if you are supposed to do a court thing, or a judge thing. but sending him a letter cant hurt imo. but keep on time of the other things that he requires for this vehicle situation whatever they may be.

        The reason I feel so panicky about the situation is that he told me he didn't have time to fool around and that I had to make a decision and call him at his office either today, tomorrow or Wed. I did get an estimate for repairs today that came to $2100.00. I have that in hand. I also have some ebay auctions for trucks that sold for less. I guess I'll call him tomorrow. I would just let him have it if I thought it would sell for a fair price but sometimes, somehow other lawyers or relatives just get to buy it cheap. If that happens I'm really screwed even more.

        Does anyone know if I can find out where and when the auction will be held or if it will be online and would I be allowed to attend? I might could get a friend to buy it for me if it goes at the right price kinda like Minnie is doin'. If it should actually go for the $5600 he thinks it is worth, heck, I'd rather have the money.

        I don't think he really wants it either. It looks like a game of who blinks. Unfortunately, he has nothing to lose while I do.

          doesnt have time to fool around? its a process and it sounds like is pressuring you becuase you dont have an attorney. im not sure what to tell you other then what i already did. most attorneys argue these points i stated to you and see what the outcome is.

          if it was me id go see free attorneys and ask them what they would do about it if you hire them. it probably wouldnt cost much even if you hired them. and in the meantime they might tell you what they would do.

            Do you have an email address for him? (Pacer listed one for my trustee.) I'd suggest putting your arguement in writing & submit it-that way you can edit, organize, etc. and not get into a situation where he can intimidate you.

            First, list the value of the vehicle as you have researched, w/ both the KBB trade in AND retail. Then note the condition and that you have a quote for repairs needed. Include info on comparable vehicles you have found advertised, such as on ebay and in your paper, etc.

            (Even if there isn't a way to submit your case to him in writing, having it written out will help you when you speak to him also.)
            Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.
