In case everyone on here didn't already know yet, Mann Bracken has collapsed and shut down. Does anyone know what that means for people who had collections through them? Mann Bracken held about 10K of debt of mine and the last correspondence I received from them was in Sept 09'. Just wondering what happens with all of my bad debt and everyone else's debt? Any help would be appreciated!

Did Mann Bracken file for BK protection? Did they actually own your debt or were they just in charge of collecting it for someone else?Pay no attention to anything I post. I graduated last in my class from a fly-by-night law school that no longer exists; I never studied or went to class; and I only post on internet forums when I'm too drunk to crawl away from the computer.

Mann Bracken was closely tied to Axiant, who file for BK protection in November and National Arbitration Forum which is in legal trouble.
It appears Mann Bracken acted like tough guys while collecting yet were stuck suckling the teat of these two other organizations.
I feel no sympathy for the clowns who are out of work now as a result of this action.Well, I did. Every one of 'em. Mostly I remember the last one. The wild finish. A guy standing on a station platform in the rain with a comical look in his face because his insides have been kicked out. -Rick

If M-B ends up filing bankruptcy I would guess the debt they own is an asset. This will delay the ability for them to sell it. When CAMCO {a real bottom feeding collection agency} was shut down by the FTC and filed bk, all of the accounts they owned were property of the bk estate. Mann Bracken stated that they did not have my original contract agreement or any proof of my debt aside from some person claiming to know that I owe it. I wouldn't think that would hold up in court. They filed some affidavit of debt with my local court but that was last year and nothing has come of it. If there was no documentation before, and no documentation when selling it, doesn't that mean that the next person who collects it I can automatically dispute and have it removed from my credit report?? Thank you!

Well, it's testimony. Evidence, in other words. So you have a right to cross examine the affiant on exactly how it is he knows you owe it. Assuming they even bother to have someone show up, you could have fun with that. Is he familiar with all your charges and all your payments on this account? How did he gain this familiarity? What documents or records did he examine? You or your attorney need to object to this affidavit on hearsay grounds unless the affiant appears to testify personally so that you can cross examine him. Right now, during the mass confusion you know is going on at MB, might be a good time to file a motion to dismiss / motion for summary judgment. Move for a trial setting.
