I imagine that it could take a few weeks-at least-for the BK court to pass the funds on to the lender.
And, keep in mind, they will come after you for anything that wasn't paid thru the foreclosure sale. Seeking legal counsel is strongly advised.
And, there is always the possibility that the EX didn't list the original mortgage holder on his BK petition, and I have NO clue how that would go... The 1st lien still gets priority but that could make it a pretty big mess...Originally posted by GcappsI'm confused though. Nah, not really. Not that way at least. But I certainly don't mind if she puts it to him a bit for all he did without her knowing.
The people who rented this house before us were gone prolly 6 months, at least, when we moved in last summer. We are STILL getting mail addressed to them. It's like they didn't tell anyone their new address at all. They most definitely must not have filed a change of address notice with the Post Office. Our mailbox is out at the main road so it's not like you walk to the end of the drive to get the mail. I stop at the Box on the way out or when I come home and I hate having to remember to take their mail back to the box. At first, since it was mostly junk mail, we'd just trash it. What's one less sale catalogue anyway?? And the mail just kept coming and coming. So we got really aggressive about "returning" all their mail hoping the Postal Delivery person would stop dropping it off. Nope. Then at Christmas, the other people got a ton of Christmas cards. How bad is that??!! They didn't even give a bunch of their "friends" their new address??!! Sending back the Christmas cards seem to have done the trick with the Post Office, tho. There is absolutely no way a foreclosure auction can happen on a property without all lienholders of record being notified. The process makes sure of this and follows state law so that a clean title can be transfered to the buyer.
If it did actually auction off and they are contacting you for payment, it can only mean there is some kind of gross error in their billing dept or they are still owed money. Their security interest in the property no longer exists though.Last edited by JimH; 01-15-2006, 08:35 PM.
