    Discover Card - Will they give me a hard time?

    Someone just told me that Discover gives people going through bankruptcy a hard time. (FYI: I have a no asset case with no risk of being forced into Chapter 13 or being accused of fraud.) I know that they treat people in credit counseling terribly. I don't see what they could do to me, but I'm in the 60 day club and so hearing stuff like that stresses me out.

    Anyone else in Chapter 7 been given a hard time by Discover? Or (to be fair) gone thru Ch 7 without problems from them?

    If nothing else, there'll be a thread here for folks with the same questions.

    yes ive heard that too. but to be honest the charges have to be recent and large just like any others. for whatever reason creditors just dont come out and harass us. i was worried about that too.

    so most creditors come after you if its in the 90 or less time period maybe. so for example discover might come after you if you were in 180 time period. anything over 1+ years however it seems like it just doesnt happen much.

      See, that's the thing with my case... haven't charged anything on any card in quite a while. Besides - they can come after me with every lawyer on the eastern seaboard if they want - I've got nothing to give them! I can't imagine they'd waste time and money on me.

        well that does factor in a bit but not really as much as youd think. it all starts based on when the charges were made and for what and it goes from there. they are perfectly happy making you make payments.

        how long ago were the charges and for what?

          Nope - no problems. They were ugly until they (finally) accepted atty's name & number prior to filing, but no problems @ ~75 days post 341 mtg.

            stormcrafter - a friend of mine and her husband tangled with Discover in court twice. The first time Discover got a judgement and my friends agreed to pay them when the sale of their land was completed. The sale fell threw but instead of contacting Discover they procrastinated and tried to sell the land again. Discover got a court order and emptied their savings and checking accounts. My friend's husband had direct deposit so Discover was able take a good portion of what they were owed. To be fair to Discover(this time) my friends are the poster children for procrastination so they deserved pretty much what they got. Discover and my friends ended up in court again but because Discover had jacked up the interest so high the balance was more than general sessions court handles so the judge told them to deduct a lot of it or take it to another court. They deducted a lot of it and now my friends are making payments. I dont like Discover because we had a card with them a long time ago; paid it off and they added in some stupid fee that we had to pay and wouldnt budge on taking it off despite the fact we had paid off a big balance. I dont think your circumstances warrant them doing anything. For me it is a card I will never have again. We all understand your anxiety but I really believe you are on your way to discharge.

              i agree with you. discover is nothing but problems in or out of bankruptcy. its like they are so greedy because they are not the big boys on the block! the hell with them. why bother using their card when there are so many others that will give you a normal hard time

                they gave me a hard time before I filed. They got a judgement against me for $13,000, put a lien on my wife's property, yes wife's property, and got an order to garnish wages. Too bad my employer paid me 80% cash when he got the notice in case he had to garnish my wages, which he didn't because I filed Chapter 7 before the next pay period began. HA HA HA HA Let them squeal like a pig, those bastards are rich,rich,rich,their shareholders are very happy with their earnings, and it's a write-off for them. Obviously, when they received notice of my case, the lien was removed the same week, the payroll judgement reversed.

                So yes, they can be nasty, but if you've got nothing, they get nothing.

                  Honestly speaking, I really didn't have any problems with Discover and I was discharge not to long ago. I had $4000.00 + on my discover card.
