    341 Tomorrow 12/19

    Hi all, you have been so very helpful. I have my 341 tomorrow, and I am a little nervous. here are the questions I have and what the trustee asked

    1.) He asked for Bank Statements for 2 months before I filled Why did he ask for this? All I have is bank statements from 1 month before I filled beause the checking account was not oppened before then.

    2.) Why does he not want a current banking statement?

    3.) I didnt list anything to exempt except for furniture and clothes which totalled $650. my cash on hand was actually
    -100 because I over drew my checking account will that work for cash on hand section? I have no car (someone stole it) I live in an apartment so I have no house. This should be pretty easy meeting right?

    4.) The trustee also asked for my 2 paychecks before I filled and I only have the 1 check that I got when I filled and 1 check I got after filling. Do you think this will work? if not will they atleast give me a couple days or a week to get the right ones to them?

    Any advice would be great. Thanks all for your support.

    The trustee probably wants to see checking statements prior to filing in order to see if any large transactions happened. Your bank statements after filing really aren't important-your financial situation as of the file date is the important thing.

    You said you only have 1 statement because its a new account. Did you not have an account before, or bank somewhere else? If you had another account, take the statement from that.

    If you are on a new job, having only one stub should be fine.

    Out of curiosity, you mentioned that your 341 is tomorrow. How long ago did you receive notice requesting paperwork. If its been a while, your trustee will not thrilled that you need more time to get it together.

      I filled oct 14, it is not that I need more time, I just don't have my prior paystubs, because I did not save them, as of Bank account statement, I did not have a bank account prior to this one..... I had to print my on-line account statements, or detailed transactions because the bank would take 2 weeks to send, and as far as paychecks like I stated I don't keep them all. I asked my employeer to to give me my prior check stubs, and they are going to get them, but haven't got them to me yet.

      Any other advice from anyone?

        Sounds like you should be in good shape. Give that same info to the trustee-its not unusual for people to not save check stubs, and you've taken steps to get replacements.

          take what you do have. make sure that if more paperwork can be obtained that you are able to tell the trustee that it is being requested and you will provide it to him as soon as possible.

            --Will the trustee want to keep these documents? or will he just look at these at the court place? Or both?
            --will he ask about these documents at the meeting?
            --if he does take these and finds them confusing, will he ask me to explain them? or will he just file an objection? if he does ask me to explain them how will he contact me? By phone? or by address?

              he wants copies only.

              the rest of the questions are answered like this: they all do it differently. you are gonna have to wait and see.

              however, if you didnt bring something he askef for then make sure its on the way or you have a reason for not having it. trustees dont mess around much.

                So that means he will want to take these copies home with him? And I may not find out if he objects to these until later?

                And if I only have originals will he take those?

                  well, i guess he could do anything he wants to. take the copy or let you keep it. but i would imagine he is going to take the copy. so go make a copy before you get there.

                  yes you will not find out if he objects to something until later. keep checking pacer for the quickest answer and always check you mail at least.

                  dont worry. he will be friendly just as 99.7% or all the others are toward the filers. it will be the most pleasant experience in your entire bk process. i kid you not. tell me if you dont agree afterwards.

                  the 341 is not a process of debate and determination of laws. its just a formality they really should do away with by signing a document swearing that everything is true, etc. its a BS meeting. no creditors show up so it is mis-named 'meeting of the creditors'. go early to see how others metting goes.

                  you are gonna be ok and if you need anything else then either he will extend the 341 or let you fax it to him.
