    Time for Filing Claims

    bkfiler should love this. My 341 was 12/8 and date for discharge was 2/6. Well after entering into an agreement w/ the local trustee to split some income after taxes next year, today I checked on PACER and found this from the U.S. Trustee.
    "Now that there are assets, blah, blah, blah, The last date to file claims is 3/22/06. The last date for a governmental unit is 4/11/06"
    What do you think, gang? Does this mean that ny case will not be discharged until 4/11? At what date will it be closed as far as I am concerned?
    There was also a notice from the local Trustee that outside of this income and the agreement we had reached that all property is inconsequential and burdensome and the trustee proposes to abandon all property other than our agrement. 12/19/05
    Any thoughts would be deeply appreciated. Art (First member of the 162 day club???)

    hey aaart, we are getting to be old timers here, nothing is phasing me much anymore. trustees are still greedy bastards. they fall head over heels at the sniff of a nickel.

    but, if you look at the overall picture it looks like you are probably fine. its standard to change the date if he wants to or if there were assests found so creditors can complain about him and how he addresses the split of those assets. imo your case, with the new ruling about taking only half, is going ok.

    extending the date probably doesnt effect you anymore cuz if there were complaints about other stuff they would be in by now id imagine.

    it seems to me you know what the trsutee wants, except for the 2005 stuff-thingy-majig. focus on that and how you will use that to help you live on. its just my thoughts but i think everything is going a bit better then before no?

    dont worry, you are excepted into any club you want. staci has beaten me and threatened me with trsutee audits and creditor objections so much ive had enough! everyone can join any club they want regardless of actual fact, race, creed, sex or no sex, outfit type or color of hair.
    Im not an attorney or a trustee. You cant trust me either though!

      It shouldn't change your discharge date. The original 341 notice has a comment to the creditors not to submit a claim unless they are notified to do so. I imagine that is because the court doesn't want a bunch of claims when the majority are no asset cases. Now that yours is an asset case, the creditors have been notified and they have to hold out their hand to get a cut.
      Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

        Staci, I hope that this is the case re: discharge. I'm not quite up to bkfiler yet on PACER charges. They were $.48 throught the end of last month and I prob spent $.82-$.88 today. (I know, I know, could've gone in one of those things called savings accts. ), but it was worth it to me to try to get on top of this. I needed to know if my approx. $3200 check next week was going to be all mine, not mine at all or 1/3 mine, 1/3 for taxes and 1/3 for the Trustee. Looks like the last is the answer. Art

          As long as you keep Pacer under $10, no bill... (Unlike those of use who researched other cases, LOL!)
