I didn't realize until today (my 341) how important a good attorney is. We went into a large room with abot 10 people scheduled for 11:00 a.m. My attorney explained that he knew the trustee very well, and gave us a heads-up to the type of questions that he would ask. We were the first ones called in and it went very smoothly. After the meeting my attorny assured us that it went very well and there was nothing to worry about. I asked him how well he knew the trustee, and he said "very well". He was with him for several meeting the previous day. They are both attorneys in the same town. I honestly feel that without my attorney today, things would not have been as easy. We have a very tricky and questionable Ch.7 case, and it was way too routine. My advice to anyone just starting this process is to do your homework and find an experienced BK attorney. If possible, research the trustees in your area and find an attorney who is familiar with them. Hey, you wouldn't hire a brick layer to put on a roof, right. Get the best that you can, even if he or she costs a few extra dollars up front.

Sounds like you lucked out, congrats.
My attorney's office: a) doesn't believe in returning calls or emails, b) when you are lucky enough to get them off the phone they find it 'okay' to keep you on a speakerphone, and my fav:
At the 341, he was in the room all of 2 mins. He took off, and had myself, a few other clients, and the trustee waiting around for him for nearly 30 mins. I tried to ask about what to do with my car after the hearing and he practically threw me out of the room.
I won't even get into the problems I had just getting the petition done right.
All I can say is 'thank goodness' it's done & over with.I'm not a lawyer or legal expert, just offering advice on what I may have gone through and/or have knowledge of. Good luck!
341-done
Last date for objections: 02/21/06 - done
Discharged: 02/24/06

Until things settle and a better understanding is gained about the current bk law process, I'd say that someone filing NOW is better off w/ an attorney.

You don't always need an attorney! Most of my information is from personal experience or HOURS and HOURS of online research. When you're searching online, keep in mind there is no guarantee that the info is completely up to date, and your situation is unique from anyone else's. Do your homework, and consult with an attorney so you can make an informed decision.

This is the reason a potential bk-filer should consult with several attorneys. Make them earn your business.

Extrememly scary now with an attorney in your corner - too many changes, too much red tape............ too easily dismissed.....
Choosing a good attorney is hard, pick one you feel comfortable with, answers your questions, and remember HE TOO is now responsible for your petition.....Minny

My suggestions are from "personal experience" and research only. Do not consider this as legal advice. Each bankruptcy case is different.

First of all, we lucked out and got THE GREATEST ATTORNEY EVER
2nd - I hope to never do that again (I learned that eating one's own words were poisonous)
3rd - Those that filed pro se - my hats off to you. Our attorney earned her money, all the emails and phone calls Her and her husband's picture are in Webster's Dictionary beside the word Patience.
4th - If the above isn't enough, sitting in the 341 meeting will make a believer out of you. That is the real test.
**Always remember that ultimately you are responsible for knowing and providing the true and correct information to the courts.**
I'll be watching, you may never know when or how, but I'll be there. I am there now....
