Hello, i have filed ch7 in Oct last year,and am awaiting another 341 meeting of creditors since the first one did not go to well, (long story, see in "desperate need of advice" if interested in the general bk topic) I don't want any more surprises for my second meeting. I have a 401k loan that was taken out a few days before I filed bankruptcy so I could catch up on some bills and I could pay the attorney. my lawyer did list the amount of my 401k but not the loan since I had not received the check yet, and he says not to worry, but I keep hearing differently. Should I tell him to ammend the shcedules and let the trustee know? I am repaying it through payroll deductions weekly $32.00 the total amount taken out was $3,000 I have no money left from that amount in case the trustee wants it. Also I did not include two of my creditors, a PC richard CC that I used to buy a television, the lawyer adviced me to not include it and just pay it off which I did but after the bankruptcy was filed and before my first 341 meeting. Is there any way he could find out? the other one was a Gap card that I forgot with a very small balance $125 and I also paid that off before the 341 meeting. I am just so nervous of the upcoming meeting since this trustee is a Monster and uses very abusive language.
He basically screamed at me and accused me of things for the entire time we had the meeting. (He also kept making derogatory comments to other people so I was'nt the only one) I hate my lawyer and basically am stuck with him since I can't afford another one. Should I stand up for myself and tell the trustee not to scream at me and not be condescending in his comments? I understand he has a job to do, but there is no need for the rudeness.
