    What if..........Chapter 7 Question

    Lets say that the day before your sixty day waiting period is up and the trustee finds a reason to delay the discharge based on the possibility of
    some type of payment he could recover............do you have the choice
    to move forward with his/her decision or could you ask for a dismissal and
    cancel the filing ?

    I think it will depend on the issue. If the trustee finds that you have intentionally listed false info (such as 'forgetting' that you had $10,000 in the bank, or listing your home at a 10 year old appraisal value) simply getting the case dismissed may not happen. The trustee makes $$ off of finding assets, afterall. If it is something else, perhaps the US Trustee questions your $500/mo cable bill and wants to convert you to a 13, you could not be FORCED to convert.

      anything of nature he will not find, my conern is we cashed a 401K in about 90 days before filing so we could make the house, car, utility payments, basic
      living expenses................nothing illegal or shady. he ask for a listing of the payments which we provided....................think everything will be ok based on lawyer advice but you never know.

        That should be fine. He is probably curious to see if you cashed it in to hide the money. (Such as if your 401k was NOT exempt.) Even if your 401k was exempt, he could be looking for signs that you're hiding assets overall. Using it for living expenses is ok.

          more information

          he wanted all payments over $600 which we listed, think its a formality and nothint to worry about................this whole process is something no one wants to get use to !!
