Filed ch 7 right before new laws, had 341 60 days coming up on Jan 18. Trustee keeps sending mail asking for more info, we filed pro se, thats why isn't it? Have complied with everything he asks, now he says we are $807 over personal property allowed and we did not spend a cash gift given to us by a family member appropriately so wants $1900 of that, says we can make payments over 8 months. Also wants our income tax check, unsigned, says it will be deposited into trustee account, they want 77.81% and they will send us back whatever is left over. We pay our proerty taxes and homeowners insurance with that money every year, what do we do now, any ideas??

sorry to hear that. i would seek counsel and try to stop him dead in his tracks. consult with 3 or more and see what they say.
yes when trustees smell money and then also see you are not represented they are more apt to go after you. the problem then becomes not knowing what to do or how much is fair, etc.Im not an attorney or a trustee. You cant trust me either though!

Well, that's the trade off people make not having an attorney.
Sometimes it's no biggie, sometimes..it is.
$2700 plus 78% of the tax return in exchange for peace of mind? and relief?
I'd take that in a NY minute.

BK - first of all did you declare that digital camera (I am surprised that it works with the content of the pictures you take)
Secondly, don't be so touchy, Becky C was only trying to be nice (she couldn't have been serious)
I agree with Genenco - I paid my attorney around $1100, she is worth 3 times that. I didn't mind paying it for the peace of mind it gave me. She was extremely thorough and knew what she was doing.
It is not to late to get an attorney and it will probably be easier because many, prior to the deadline quit taking new clients and now should be about cleared up with the old cases. Besides they know the trustees and know how to placate them.
As far as the tax refund,I am not sure.
Our attorney counted our refund as income and divided it by 12 to add to our monthly income. We paid home oeners property tax, heating bills, things like that too.
Keep us posted, good luck.
(remember, even if they take it, in the long run you are way ahead than you were when you filled bk.)
I'll be watching, you may never know when or how, but I'll be there. I am there now....
